3. Intellectual property

All the elements making up the site and the service (texts, images, illustrations, photographs, videos, logos, graphics, icons, sounds, source code) are the exclusive property of the publisher or its partners and are protected by French and international laws on intellectual property and copyright.

The CallEat brand, the logo and the associated graphic elements constitute a trademark for which registration is pending. Any reproduction, representation, modification, publication or adaptation, in whole or in part, without prior written authorisation is prohibited and constitutes an infringement punishable under articles L335-2 et seq. of the French Intellectual Property Code.

Photo credits: some illustrative visuals come from the image bank Unsplash, under the free Unsplash licence, and are used in accordance with the attribution conditions recommended by that platform. Customer photos (restaurant storefronts) are the property of the customer establishments and published with their permission.

Source code: CallEat uses open source libraries; the list and associated licences can be obtained on simple request to contact@calleat.fr.

4. Personal data

The collection and processing of personal data are described in detail in our Privacy policy, drawn up in accordance with Regulation (EU) 2016/679 (GDPR) and the amended French Data Protection Act.

Under these texts, you have in particular a right of access, rectification, erasure, objection, restriction and portability. For professional customers who entrust personal data to CallEat as controller, a data processing agreement (DPA) is available pursuant to article 28 of the GDPR.

5. Cookies

The site uses cookies to ensure its operation (authentication, security, preferences) and, subject to your consent, to measure its audience and personalise content. Cookie management is detailed in the privacy policy and accessible at any time via the cookie banner on the site.

In accordance with the CNIL recommendations and article 82 of the French Data Protection Act, no non-essential cookie is placed before your consent is obtained.

6. Limitation of liability

The publisher endeavours to ensure the accuracy and updating of the information published on the site. It cannot, however, guarantee completeness or the absence of error; it declines all liability for the consequences of any imprecision, inaccuracy or omission concerning the information available on the site, as well as for the continuous availability of the site.

CallEat is a service and front-of-house management software: it is not a certified cash register software or system (article 286, I-3° bis of the French General Tax Code) and does not issue a fiscal receipt. The fiscal recording of payments and the daily closing (Z report) fall under the restaurateur’s certified cash register system.

7. Hyperlinks

The site may contain hyperlinks to other websites. The publisher exercises no control over these third-party sites and declines all liability as to their content, their privacy policy or their terms of use. The presence of a link constitutes neither an endorsement nor a partnership.

Any hyperlink to the calleat.fr site is authorised subject to fair, non-commercial and non-disparaging use. A simple notification to contact@calleat.fr is appreciated.

8. Applicable law and jurisdiction

This legal notice is governed by French law. Any dispute relating to its interpretation or performance falls, failing an amicable agreement, within the jurisdiction of the courts of the Aix-en-Provence Court of Appeal (Marseille).
